EXPERT WITNESSES IN MARYLAND DIVORCE CASES

At the commencement of a divorce action in Maryland the court will issue a Scheduling Order which, among other things, set a specific date to designate expert witnesses. Maryland Rule 5-702 dictates the terms and conditions of the expert’s testimony. Such experts may include real estate appraisers, jewelry or art appraisers, boat appraiser, accountants or business evaluators just to name a few. It is of paramount importance to name the proposed experts by the date ordered by the court. If a party fails to name the expert by that date it is likely the expert will be unable to testify at trial. Failure to have the necessary experts testify can doom an otherwise excellent case.
